Terms of Sale

Purchase of any goods sold by Ditch Witch ACE is expressly limited by the terms and conditions contained herein. No changes, waivers, or additions to these terms shall be effective unless agreed to in writing and signed by Ditch Witch ACE. Buyer acknowledges that these terms supersede any purchase order or other documentation provided by the Buyer. Any conflicting or additional terms are void and have no effect, except for delivery and billing addresses, quantities, prices, and items ordered. Ditch Witch ACE reserves the right to amend these terms at any time. Continued ordering constitutes acceptance of any updated terms.
 
Payment & Account Terms

• All accounts are Net 10, unless otherwise specified
• Accounts over 30 days are subject to a 1.5% monthly service charge (18% annually)
• Buyer is responsible for all collection costs, including reasonable attorney’s fees

 
Title & Risk of Loss

• Title and/or possession of all goods remains with Ditch Witch ACE until paid in full
• Ditch Witch ACE is not responsible for loss or damage due to fire, weather, theft, or other causes beyond its control

 
Equipment & Property Disclaimer
Ditch Witch ACE is not responsible for:

• Personal property left on equipment
• Damage to trailers, bodies, or special equipment
• Loss or damage to materials or cargo carried on equipment

 
Returns

• A 20% restocking fee applies to all returned parts
• Returns may be denied or fees increased for:
  • Damaged packaging
  • Signs of wear or use

 
Warranty
Ditch Witch ACE guarantees customer repairs against defects in material or workmanship for one (1) year.
 
Acceptance of Equipment
Customer signature acknowledges receipt and delivery of equipment.

• Taxes, shipping, and surcharges are additional and calculated at checkout

Orders & Acceptance
Order confirmations do not guarantee acceptance.

• Limit quantities
• Refuse service
• Cancel orders prior to delivery
